By accessing or using the Workplace Hazard Vulnerability & Prioritization (WHVP) Risk Assessment Checklist (the “Tool”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Tool.
The Tool is designed to assist designated employer representatives in conducting risk assessments in accordance with the Canada Labour Code [CLC, 125(1)(z.16)]. It is provided for informational and guidance purposes only and does not constitute legal advice, professional engineering advice, or a comprehensive safety audit.
You should consult with qualified legal, safety, and industrial hygiene professionals to ensure full compliance with all applicable federal, provincial, and territorial regulations.
The Tool is provided “as is” and “as available” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or completeness. The operator of this Tool disclaims all liability for any loss, damage, or injury arising from its use.
You agree to:
Assessment data is stored securely in Firebase Firestore or Supabase, depending on the configured provider. You are responsible for retaining copies of your assessment records as required by applicable regulations. We may retain assessment data for a reasonable period but are under no obligation to maintain it indefinitely.
In no event shall the operator of this Tool be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Tool, even if advised of the possibility of such damages. Your sole remedy is to discontinue using the Tool.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Tool after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
If you have questions about these Terms, contact the designated employer representative within your organization.
